State Rep. Doug Wozniak this week voted in support of a measure to ban kratom, commonly referred to as “gas station heroin,” taking action to protect Michigan families from a dangerous and largely unregulated substance.
House Bill 5537 prohibits the production, sale, and distribution of kratom products, which are increasingly being sold in forms like gummies, candies, and drinks at gas stations, vape shops, and liquor stores across the country.
“These products are being marketed in ways that appeal to young people, but the reality is they can have serious, even deadly consequences,” said Wozniak (R-Shelby Township). “Kratom is not harmless. It has opioid-like effects, making it highly addictive, and has been linked to deaths. We cannot afford to ignore the warning signs and risk another public health crisis.”
Wozniak emphasized that many individuals are unaware of the risks of kratom use, as it is frequently marketed as “natural” and perceived as a safer alternative to painkillers, stimulants, and other substances. He also noted that these products are often sold without clear warnings or guidance on appropriate use.
“This is about getting ahead of a growing threat before it spirals into something far worse,” Wozniak said. “We’ve seen what happens when dangerous substances are allowed to spread unchecked. This plan puts protections in place to help keep our communities safe.”
Wozniak noted the bill includes a provision allowing kratom that is approved by the Food and Drug Administration as a drug product, dietary supplement, or food additive.
“Should the FDA approve future use of kratom, then the substance would be regulated and legal for that use,” Wozniak said.
House Bill 5537 passed in the House and now moves to the Senate for further consideration.
